Just Purchased a Car, Consider the Lemon Law

by | Mar 15, 2018 | Lawyers

The lemon law is not a new term, but more and more people are considering it when they buy a new or used car. Every state in the US has laws that pertain to vehicle warranties. You can find out more about your state’s rules governing such laws so that you can determine if you have a lemon and what you can do about it.

What it Is

The lemon law means that if the vehicle has to be repaired multiple times (at least three) for the same issue within the warranty period, then the vehicle qualifies under this law. Each state differs when it comes to these laws, so it’s a good idea to do a lot of research or hire an attorney to help you through the process. They have experience and knowledge of the car industry, so they can ensure that your situation qualifies.

Do You Have a Lemon?

If your brakes don’t work or the windows go up/down by themselves, you could have an issue. However, it’s important to understand that having a problem and requiring a repair doesn’t necessarily mean that the vehicle is a lemon. The manufacturer has to be given an opportunity to fix the defect, and the defect itself must impair the use of the vehicle, safety, or value. For example, the brakes not working is a safety issue. The windows going up/down could also be a safety issue and could lower the value of the vehicle.

Should You Get a Lawyer?

While most people prefer not to involve legalities, you may need help. They can assist you with getting all the necessary documentation on your vehicle.
