The Texas Lemon Law can be Hard on You

Under the Texas Lemon Law you can receive compensation for defective cars and trucks along with other vehicles such as RVs, boats, and motorcycles. Typically your vehicle must have had numerous repair attempts under its factory warranty. Under the Texas lemon law you can get a full refund of your purchase price, the replacement of your vehicle, or cash.

How do You Know if Your Vehicle is a Lemon?

There are seven conditions that your vehicle must meet in order to be declared a lemon:

  • It must have a very serious effect.

  • The defect has to be one that must be covered by the manufacturer’s warranty.

  • You must have told the dealer for the manufacture about this within the warranty period.

  • You must give the dealer or manufacturer a reasonable number of tries to repair said defect.

  • You must give manufacturer written notice of the defect by certified mail.

  • The defect must greatly impair the vehicles use or its market value or create a serious risk of bodily harm or death.

  • You have filed your complaint and paid the filing fee under the Lemon Law statute.

There are Three Tests

Finding out how many chances a dealer has to repair the defect is simple. Under the law it is presumed that you have given the manufacturer or its authorized dealer a reasonable number of attempts if you pass the serious safety hazard test, four-times test, or the 30-days test. If you receive a loaner vehicle while your car is being repaired, that time will not count toward the 30 days.

Complaint Timeframes for Filing

A Lemon Law complaint should be submitted within six months following the earliest of these: the expiration of your warranty term, 24 months or 24,000 miles from the date you took delivery of the vehicle. To be on the safe side, you should file your complaint as soon as you realize there is a problem making repairs on your vehicle.
